Bradley Aiken is a trial lawyer in the firm’s Houston office. Brad’s practice focuses on a wide range of commercial litigation matters, including appellate litigation; financial services litigation; life, health and disability insurance litigation; stranger-owned life insurance litigation; business-organization litigation; securities litigation; labor and employment litigation; professional-malpractice litigation and litigation of general complex commercial disputes. In addition to his commercial experience, Brad has experience representing individuals in matters involving identity theft, credit repair and debt-collection litigation.

Brad has practiced in numerous venues and jurisdictions across the country. Brad has experience in state and federal courts in Florida, Georgia, Nevada, New Mexico, Oklahoma and Texas. Brad also has experience litigating matters before the United States Court of Appeals for the Fifth Circuit, The United States Court of Appeals for the Eleventh Circuit, and the American Arbitration Association and in FINRA dispute resolution.

After graduating from the University of Texas with a degree in finance, Brad worked at Morgan Stanley & Co. as an investment-banking analyst. As an analyst, he focused on oil and gas issues in the southwestern United States; advising clients on financing, mergers, and acquisitions; and strategic-structural alternatives.

Brad is actively involved in the community. He is the founding President of the University of Houston Law Alumni Foundation Moot Court Alumni Committee, the current Fundraising Chair for the Moot Court National Championship, a member of the Law Captains Committee of the University of Houston Law Alumni Foundation, and the former Competition Director for the Moot Court National Championship. Additionally, Brad is an avid supporter of The University of Texas where he was a captain of the swimming team.

Brad enjoys spending time with his family, volunteering with the Houston Area Special Olympics, and pursuing backpacking and photography.

Representative Matters

Represented various insurance companies including Standard Guaranty Insurance Company, American Security Insurance Company, American Bankers Insurance Company of Florida, Safeco Surplus Lines Insurance Company, and Ranchers & Farmers Mutual Insurance Company in numerous first-party property insurance litigation matters, including Hurricane Ike litigation. Brad’s representation in these matters resulted in important precedent regarding causation and the use of expert witnesses in the U.S. Court of Appeals for the Fifth Circuit.Represented American General Life Insurance Company and its various affiliates in numerous first-party life insurance and annuity litigation matters.

Represented The Phoenix Companies in connection with a wide variety of stranger-owned/originated life insurance (SOLI) litigation matters.
Represented Luhrs Corporation in matters related to consumer tort and Texas statutory claims.

Trial Experience and Dispositive Results

Cause No. 957699; Michael Heartsong v. Executive-Top Gun Search LLC; in the County Court at Law #4, Harris County, Texas.  Achieved a unanimous jury trial victory in matter related to misrepresentations and breach of an employment search services contract.  The jury awarded all actual damages and attorney fees of 4 times actual damages.
Civil Action No. 4:09-cv-02070, Bonnie Bias and Vickie Bias Burrell v. Standard Guaranty Insurance Company, et al., U.S. District Court for the Southern District of Texas. Obtained a take-nothing judgment in a $1.3 million property insurance dispute.
No. 09-20784, Bonnie Bias; Vicki Bias Burrell v. Standard Guaranty Insurance Company, U.S. Court of Appeals for the Fifth Circuit. Drafted a successful brief to the U.S. Court of Appeals for the Fifth Circuit in which the court affirmed a take-nothing summary judgment and multiple orders striking the plaintiffs’ evidence and expert testimony in favor of Standard Guaranty Insurance Company in a matter related to alleged violations of the Texas Insurance Code and bad faith.
No. 09-20403, American General Life Insurance Company v. Michael Kirsh, U.S. Court of Appeals for the Fifth Circuit. Drafted a successful brief to the U.S. Court of Appeals for the Fifth Circuit in which the court affirmed a $670,000 judgment in favor of American General Life Insurance Company against an insurance agent for return of commissions.
Arbitration No. 70 160 00620 08, American General Life and Accident Insurance Company v. Lucinda Martinez, American Arbitration Association. Obtained a $46,000 award in favor of American General Life Insurance Company for claims of fraud, breach of fiduciary duty, and civil theft in an employee-embezzlement dispute.
Arbitration No. 09-01419, Mary K. Gordon v. Jeffrey L. Endicott, Compliance Analyst AIG Advisors, Retirement, FINRA Dispute Resolution, Dallas, Texas. Obtained a take-nothing award in defending against allegations of breach of contract and fraud in an insurance dispute related to alleged violations of, among other things, the Texas Insurance Code.
