CHICAGO, ILLINOIS – A Cook County, Illinois judge granted a motion to dismiss filed by EMH on behalf of its client, a large annuity company, in a case seeking millions of dollars in damages allegedly resulting from a stranger-initiated annuity transaction (“STAT”).
 
The Plaintiff alleged that investors fraudulently obtained sizeable annuities through several insurance companies, including EMH’s client, in a STAT scheme involving the use of his terminally ill sister as the named annuitant.  The annuitant passed away shortly after the annuities were issued.  The Plaintiff filed suit to impose a constructive trust on the annuity proceeds and asserted claims of negligence against the insurance companies, arguing that they were somehow culpable in hastening the annuitant’s death.  EMH successfully demonstrated that the claims against its client were deficient under Illinois law.
