Home > News > Pro Bono Victory for EMH Houston, TX (November 21, 2011) -- After a three-year legal battle, EMH client All American Youth Football and Drill Team Association, Inc. ("AAYFDT), a youth football league located in Northwest Houston, has emerged victorious in a court battle over the name of one of its teams. A competing youth football league brought a lawsuit in late 2008, alleging that EMH's client committed various torts by naming one of its youth football teams the "Klein Bengals." The competing youth football league sought more than $100,000 in damages. EMH argued that its client did not copy the name "Klein Bengals" from the competing youth football league, but like thousands of sports leagues across the country named its youth football teams after National Football League teams - in this case the Cincinnati Bengals. The parties proceeded to a bench trial. After hearing the evidence, Texas State District Court Judge Caroline Baker signed a judgment on November 21, 2011 for EMH's client, ordering that the Plaintiff take nothing. EMH partner Andrew Edison represented AAYFDT on a pro bono basis. |
